Proteam declare Dusan Borkovic will be in breach of contract, if not in Hungary

The back-and-forth between Proteam Racing and their former driver Dusan Borkovic continues to escalate ahead of the next round of the FIA World Touring Car Championship in Budapest. The Italian team have now released a statement, a day after the Serbian confirmed his switch to the European Touring Car Cup with the NIS Petrol Racing Team, saying he will be in breach of contract if he does not race with them next weekend.

Borkovic switched from Campos Racing to Proteam Racing for thr 2015 WTCC season, but with ongoing issues for the 6ft 9in driver's seating position in the small Honda Civic, as well as concerns raised by his management over the specification of Proteam's car in comparison to the other Honda Civic WTCCs in the championship, Borkovic withdrew from the second round of the season at Marrakech race last weekend.

Bowing out of the series

Yesterday it was confirmed he would not return to the WTCC this season, instead planning to race a SEAT León Cup Racer in the European Touring Car Cup, which supports the WTCC next weekend at the Hungaroring.

Proteam Racing have issued a statement today claiming that he will be in breach of contract if he does not take part at the Hungaroring with them in the WTCC.

Binding contract

"The contract with the driver, Mr. Dusan Borkovic, is currently in place and is binding, just like any contract. Both parties, as in any legal system, are not allowed to resolve the contract unilaterally," said the statement from the team's lawyer Marco Baroncini.

"Therefore Mr. Borkovic must participate with Proteam Racing's car at the next FIA World Touring Car Championship race, scheduled for May, 1st-3rd at the Hungaroring circuit in Budapest."
