DAYTONA BEACH, Fla. (Sept. 5, 2003) - On Sept. 4, 2003, the National Stock Car Racing Commission heard and considered the appeal of Jerry Robertson. The appeal pertained to a penalty issued by NASCAR following the NASCAR Elite Division, Featherlite Southwest Series race at Colorado National Speedway on August 16.

The penalty assessed by NASCAR was:

. a $2,500 fine ($500 for each of 4 four altered tires, and $500 for an altered carburetor throttle body base plate)
. suspension from NASCAR until the fine is paid
. probation until December 31, 2003

Upon the conclusion of testimony and due deliberation, the National Stock Car Racing Commission unanimously decided to modify the penalty as follows:

. the $2,000 portion of the fine for the four tires is rescinded
. the $500 portion of the fine for the carburetor throttle body base plate is upheld; suspension until the fine is paid
. probation relating to this matter is rescinded

The Appellant has the right, under Section 15 of the NASCAR Rule Book, to appeal this decision to the National Stock Car Racing Commissioner.
