Nextel Cup driver Scott Wimmer was arrested for driving while intoxicated at 2:00 am Saturday morning. Wimmer wrecked the Bill Davis team owned 2004 Dodge Ram truck in the incident.

High Point police department arrested Wimmer and slapped him with a DWI after he tested twice the legal limit on a Breathalyzer test. About an hour after Wimmer's charges, his wife Jody Ambrose was also charged by the High Point police. Her charges are for misdemeanor obstruction and delay. A court date for both has been slated for March 10th.

Team owner Bill Davis remained hushed about the incident, "We really don't have any comment right now. We are kind of figuring out the facts."

In statement released this evening, Bill Davis Racing went on to comment, "Bill Davis and Bill Davis Racing are aware of the current allegations against driver Scott Wimmer. Davis has been in contact with NASCAR, Caterpillar, and all of the current sponsors and will remain in constant communication until all of the facts have been established. Until all of the facts have been revealed, Davis is not in a position to comment on the specifics of the allegations. Davis and Wimmer will continue to work with NASCAR, Caterpillar and other sponsors until there is resolution."

A DWI in the state of North Carolina carries a minimum one month suspension of driving privileges, and mandatory alcohol counseling.

In previous years, the NASCAR rule book has stated that a driver must possess a valid state driver's license to compete in any of its weekly series. NASCAR representatives could not be reached for comment.

Wimmer, 28, was slated to start his first full season in the Cup series this year with Bill Davis Racing. The season opens on February 7th with the running of the Budweiser Shootout.
