Update on court action brought by former trustees against WKA
09.14.2010 - On August 10, a hearing was held in the District Court of Cabarrus County, North Carolina on a motion for preliminary injunction by the plaintiffs in the Harper et al. v. WKA civil suit. In their motion, the plaintiffs requested the Court to reinstate them as WKA Master Members and as Trustees until the civil suit was resolved.
On September 10, the Court entered an order denying the plaintiffs' motion to be preliminary reinstated as Trustees and Master Members pending trial. At the hearing, WKA stipulated and agreed that it would, pending a final resolution of this matter, allow the plaintiffs to participate in WKA races and to provisionally earn any applicable points associated with such races, so long as the plaintiffs abide by the rules and regulations for such races. The Court adopted WKA's stipulation and entered an order to this effect.
The temporary restraining order previously entered in this action has been dissolved. Accordingly, the WKA Board of Trustees may resume normal board action and activities.
The litigation will continue to proceed with additional procedural motions and with discovery.
JOINT PRESS RELEASE: SFI, Impact resolve differences
09.14.2010 - SFI Foundation and Impact Racing are pleased to announce they have resolved their differences. Impact will remain a participant in the SFI programs in exchange for certain consideration and under revised contracts. The parties look forward to a constructive working relationship to benefit the racing industry and to promote the safety of its participants.
Impact agrees and accepts that the SFI specifications are state of the art and promote a high level of safety and performance in the auto racing industry. Impact acknowledges that in prior years it did not fully comply with SFI's specifications, however these problems have been solved.
The terms of the agreement between the parties are confidential.
WKA's stance on Impact Racing products
09.14.2010 - Impact Racing Products fire resistant driving suits and restraint systems manufactured in 2005, 2006, 2007 and 2008 will not be legal for competition in WKA-sanctioned events, effective Dec. 20, 2010.
Anyone owning an Impact Racing fire suit or seat belts manufactured in the affected years should return it directly to Impact Products. Also, some 2009 and 2010 Impact Racing Products have the correct SFI and date labels, but the date label is not punched. These suits must be returned to Impact Racing Products to have the date label punched properly.
Impact helmets are not included in SFI's decertification.
