The Court of Ravenna has taken a first important decision concerning the Minardi-Ligier-Mugen Honda case. In a decree the judge declared that the court of Ravenna did have jurisdiction to decide the application.

Concerning the existence of a contract, the judge is very clear: "[...] the relation between Mugen and Minardi -- as it is written in the decree -- was already reaching a point of mutual agreement so that it was legitimate to expect that the contract would have been effectively concluded. [...]"

Furthermore the Court recognize Ligier's action in the process of agreement. The decree mentions the "[...] 'nearly confessional' terms of a letter originating from Mugen in which it is made evident [...] reference to the assurance given by Ligier President, Flavio Briatore, to Mugen that it (Mugen Ltd) will not be liable to any claim made by Minardi regarding the brach of the agreements."

Notwithstanding the above and even if he considered and agreed that Mugen and Ligier are responsible for the damages suffered by Minardi, the judge has rejected our claim of unfair competition against Ligier and also our application under art. 700 cpc for a fast legal procedure.

Our lawyers see no alternative than to appeal against the decision (in order to obtain a different one) because it isn't possible for us to be contented by a moral victory that leaves unchanged an unacceptable situation.

We hope that it will possible to reach such a conclusion in the near future in order to avoid that the decision comes too late to be useful.
