The National Stock Car Racing Commission on Wednesday morning maintained the penalties enforced by NASCAR against Jimmy Spencer for an incident at Michigan involving fellow driver Kurt Busch. Spencer who drives the No. 7 Dodge for Ultra Motorsports was fined $25,000 and suspended a race, after punching Kurt Busch post race at Michigan International Speedway.

The commission's three-member panel was not sympathetic to Spencer's remorse and denied the appeal at approximately 8:30 am Wednesday morning. The unanimous decision of the commission took into consideration that NASCAR had previously warned Spencer regarding previous interactions, and that the fact that physical contact was intolerable.

Ted Musgrave will drive for Spencer in the Busch and Cup events; Spencer's truck entry was withdrawn.

Kurt Busch, who was also placed on probation after being the butt of Spencer's punch at Michigan, announced that he would not appeal NASCAR's decision to place him on probation.

" I have decided not to appeal NASCAR's penalty," said Busch in a statement. "My decision is being made even though no one to our knowledge has ever been penalized for being struck while seated in a race car. I am accepting this penalty regardless of whether or not it is fair or appropriate. My motivation in accepting it is simply to demonstrate to NASCAR and to the fans my continuing commitment to race hard, my continuing commitment to race clean and my continuing commitment to obey all the rules. This penalty has not and will not affect that commitment. And, my commitment will not be affected by the outcome of Jimmy Spencer's appeal."
