One can only express shock at today’s news regarding two of Roger Penske’s sons. The Nantucket Inquirer and Mirror newspaper broke the news that both Jay and Mark Penske were arrested just before 2:00am EST on Thursday in Nantucket, Massachusetts for allegedly breaking into a home.
Jay Penske, 33, is the owner of the IndyCar team, Dragon Racing. He and his older brother Mark Penske (35) have already been arraigned and charged with “breaking and entering in the nighttime with intent to commit a misdemeanor."
The alleged breaking and entering occurred at one of the homes located in the area of Nantucket Yacht Club. According to a police report, the incident was reported as an assault and battery when two women approached officers on Broad Street, claiming they had been assaulted by two men, later identified as the Penske brothers.
Per the local newspaper report, the Nantucket police indicated that Jay was relieving himself in the parking lot of the club. An unknown female approached him to ask him to stop. His reaction was to “urinate on her boots. He then proceeded to grab her arm and push her. (The woman) also states that Mark before he ran away pushed her and they both then ran to the house on Yacht Club property.”
The unknown female declined to press charges against the two men. It is unknown if the second female was a witness, or if she arrived after the incident took place.
The charges were filed after the two brothers attempted to evade the local police.
The Penske brothers will no doubt plead not guilty and pay a fine. No apparent word if anything was taken from the house that they allegedly broke into.
Along with the legal hassles due to Jay Penske's conduct, he also can face disciplinary actions in the IZOD IndyCar series as a team owner. Rule 9.3.1 states: "Any Member attempting to or engaging in unsportsmanlike conduct or conduct detrimental to racing, INDYCAR, and/or to the IZOD IndyCar Series, whether during an Event or on/off the Track."
