FIA International Court of Appeal Ruling Confirms Judicial Decisions.
Munich, 17 November 2009.The FIA International Court of Appeal has recently confimed the decisions taken by the Stewards and the Organising Committee of Formula BMW Europe in Valencia, giving penalties to Mu cke Motorsport after the team was found to be in breach of the technical regulations governing the series.
The Stewards had excluded the team's drivers, Michael Christensen (DK), Timmy Hansen (SE) and Jack Te Braak (NL), from the second race run at the Hungaroring, suspended them from running in the races in Valencia, and imposed a fine of ^a1,000 in respect of each of the its three cars. Subsequent to this the Organising Committee excluded Mucke Motorsport from the races in Spa-Francorchamps.
These decisions had been taken after the oil pressure relief valve springs fitted to its three cars for the Hungararian race were sealed and sent for detailed technical examinations.These examinations by dimension and by a force-deflection test revealed that each spring was of a different characteristic than the standard spring applicable for the engine.
The decision of the Organising Committee of Formula BMW Europe did, however, allow the drivers to score points in the Spa-Francorchamps rounds if they chose to drive with other teams. However, by choosing to remain with Mucke Motorsport means that they are not eligible to score points for these rounds either.
Due to the Appeal and the fact the drivers had chosen to remain with the team, all the results had to remain provisional for the remainder of the series.
